December 19, 2023

  • Meeting called to order at 1500 hours at the conference room, GWB.
  • Salute to the American Flag.
  • Moment of Silence for our departed brothers and sisters and special prayer for our service members who are serving in the military.
  • Roll call of officers.

  • Treasury Report – President Zafonte has appointed Richard Kuncken to the position of Treasurer. All accounts are paid. Treasury Report will be presented at the next meeting.

2nd VP Caruso reports:

  • Meeting minutes are now posted on the S.B.A. website.
  • If a member is filling out a 360, please consult an Executive Board Member. If another member is filling the 360 out for you make sure you read it before you sign it. Also make a copy and keep it for your records.
  • Members are reminded that Sergeants do not complete other Sergeants 360 cover sheet. On the patrol side, Lieutenants will complete and sign. On the ARFF side, the ARFF Supervisor will complete and sign.
  • Members are reminded to contact a member of the Executive Board if they are still not receiving S.B.A. e-mails.
  • 2024 is an election year in Albany. Tier 6 remains the top priority on the 2024 legislative agenda in Albany. Throughout the session, the SBA Board will be going office to office meeting with State Senators and discussing our concerns. We will be asking for help from our membership come the fall to support and help campaign for those who are friends of law enforcement. We will have sign-up sheets for various dates where you can come and show your support.
  • If any member has a candidate that they’d like the SBA to support, please see an Executive Board Member with that recommendation, and the board will discuss it.
  • Artificial Intelligence is being utilized in law enforcement.  Data is gathered and utilized to determine if an Officer will fail at their job and in some cases, it is utilized to decertify an Officer. CCIU complaints, Use of force reports, lawsuits, arrest history and employment profiles are the information that is gathered.  The AI companies allege that they can predict 85% of all major adverse investigations before they happen. President Zafonte and 2nd Vice President Caruso have been asked to be part of a committee with the Public Employee Conference to investigate AI and its effects on Law Enforcement.
  • The SBA APP will be available in 2024.

President Zafonte reports:

  • Grievances/I.P.’sStart Times Grievance is ongoing. 108 Hour Grievance next date is 1/16/2024. 20 Hour Grievance is ongoing. Firearm IP is ongoing. A.D.A. Form IP is ongoing. Off Duty Incidents IP is ongoing. Migrant Detail Brooklyn Piers IP is ongoing. New Grievances have been filed on the I.G. Office.
  • Discipline:  President Zafonte explained the dismissal of Sgt. Passarotti and summarized the 48-page decision provided by the arbitrator.  The S.B.A. will appeal the ruling.  Sgt. Passarotti retired with a full pension but did not receive any back averaged overtime pay or medical benefits.  If any member has any questions regarding the dismissal of Sgt. Passarotti reach out to an Executive Board Member.
  • Future Discipline: LGA (Delta) 25 Sergeants are the target of the failure to supervise investigation.  The P.I.U. interviews have started.  The I.G.’s Office wants the investigation wrapped up A.S.A.P.
  • Use of Force:  Make sure all boxes are filled out.  The use of force investigation is Lieutenant unit work and they are required to sign the document.  If a Sergeant is ordered to fill out the bottom of the use of force investigation, document it in your memo book and contact an Executive Bord Member.
  • Contract Meeting: Negotiations are ongoing. The holiday season slowed down negotiations.  Another meeting is expected in January.   The SBA Negotiation Team believes talks are going in the right direction.
  • S.B.A. Cards: The board is waiting for delivery.  The ordering was delayed due to the Executive Board Election.
  • Chief Pick Positions: The S.B.A. would like all open chief pick positions to go through the Office of Agency Affairs.
  • F.A.A. Complaint: All Fire Academy Sergeants and three Crew Chiefs testified in front of the F.A.A.  The Port Authority is being investigated not the Sergeants.
  • SBA Website – The S.B.A. website is up and running.  Members can access the website at WWW.PANYNJSBA.ORG.  An S.B.A. App is in the works and should soon be available.
  • Sergeants are doing good work in the field.  If a sergeant is involved or knows of a sergeant involved in a noteworthy job, please contact an Executive Board Member.
